CALL TO ORDER
Council President Jocelyn Hardman called the meeting to order at 7:01 p.m.
ROLL CALL
Jocelyn Hardman, Karen Wintrow, Bruce Rickenbach, Judith Hempfling and Kathryn Chase were present, as was the Village Manager Eric Swansen.
ANNOUNCEMENTS
Council received the Fogg Property Expedited Annexation documents from the Greene County Commissioners. Council will begin action on the request at their January 2, 2007 meeting.
The Community Information Project logo reads: "Find Yourself Here for the Holidays!"
Council reminded the audience that tomorrow, November 7 th was Election Day.
REVIEW OF THE MINUTES.
Review of the minutes from October 16, 2006: Rickenbach MOVED and Wintrow SECONDED a MOTION to APPROVE the minutes as amended. The MOTION PASSED.

PUBLIC HEARINGS/LEGISLATION
1 st Reading of Ordinance 2006-20 Annual Appropriations (w/levy). Rickenbach MOVED and Wintrow SECONDED a MOTION for APPROVAL. Swansen reviewed the ordinance explaining that it was based on passage of the Property Tax Levy. Sue Abendroth asked why the amount in the Economic Development appeared to be low. Swansen explained that the line item was referring to the Economic Revolving Loan Fund and not the proposed Economic Development Fund. The Grand Total Appropriations of all funds for this ordinance is $8,746,109. The roll was called. The MOTION PASSED UNANIMOUSLY.
1 st Reading of Ordinance 2006-21 Annual Appropriations (w/o levy). Rickenbach MOVED and Wintrow SECONDED a MOTION for APPROVAL. Swansen explained that this ordinance was based on the Property Tax Levy failing. He added that this ordinance did not include any one-time revenues. The Grand Total Appropriations of all funds for this ordinance is $7,534,444. The roll was called. The MOTION PASSED with a no vote from Hempfling
Resolution 2006-37 Approving Two Additional Employee Holidays for 2006. Rickenbach MOVED and Wintrow SECONDED a MOTION for APPROVAL. The resolution would approve Veteran's Day and the day after Thanksgiving as two additional holidays for 2006. Veteran's Day would be observed on Friday, November 10 th . The MOTION PASSED UNANIMOUSLY.
CITIZENS CONCERNS
Various individual youngsters from a larger group that was in attendance spoke to Council in support of the levy. They spoke in support of the pool, the library, the parks and the streets.
SPECIAL REPORTS
There were no special reports scheduled.
OLD BUSINESS
There were no items under Old Business.
NEW BUSINESS
3 rd Quarter Planning/Zoning/Code Enforcement Update (Distributed on Monday). Ed Amrhein, Code Enforcement Officer and Projects Manager reviewed the report. There were fourteen permits issued in the third quarter. Neither Planning Commission nor the Board of Zoning Appeals held public hearings during this period.
Charter Review Committee-Update. Deborah Benning, Clerk of Council reviewed the first draft of recommendations from the Committee. Benning reported that the Committee had made a recommendation that the Miami Township representative to the Planning Commission be a non-voting member. Benning stated that the remaining recommendations were similar to the items that had been listed in previous memos submitted by the Village Solicitor, Committee member Jerry Sutton and herself. The Committee would hold its next meeting November 14 th at 7 p.m. in Council Chambers.
MANAGER'S REPORT
Swansen reported that Time Warner would be increasing their cable fees. There was a risk management assessment performed for the village. The assessment indicated that there were items that need to be fixed, such as the pottery shed and the skate park. Swansen would be asking for volunteers to assist in the repair work. Swansen also reported that he had hired an independent land-use planning group to do the annexation survey related to the Fogg Property. He explained that he hired the group because he wants an impartial report.

The next meeting of the Council of the Village of Yellow Springs will be held at 7:00 p.m. on Monday, December 4, 2006 Council Chambers, John Bryan Community Center, 100 Dayton Street.
