MINUTES
IN COUNCIL CHAMBERS October 3rd, 2005
CALL TO ORDER
Vice President Denise Swinger called the meeting to order at 7:03 p.m.
SWEARING IN OF NEW COUNCIL MEMBER
Mayor David Foubert administered the oath of office to new council member Jeff Singleton. Council members welcomed Singleton.
ROLL CALL
Denise Swinger, Mary Alexander, Bruce Rickenbach and Jeff Singleton were present. Interim Village Manager Phil Hawkey was also present. Jocelyn Hardman joined the meeting at 7:20 p.m.
ANNOUNCEMENTS
Alexander gave a brief report on the Volunteer Recognition Night that was held to honor volunteers of the various Council commissions, committees and boards. For those who were unable to attend, Alexander stated that they could pick up their certificates from their council representative or from the Clerk of Council.
Alexander announced that she would be resigning from her position as Council- person sometime between the end of November and the end of March. Alexander stated that her resignation was due to health reasons. Council members, understanding the reason, hoped that Alexander could stay as long as possible.
Swinger announced the Underground Railroad Program hosted by the Yellow Springs Historical Society is scheduled for Tuesday, October 11 th at 7 p.m. at Mills Lawn School. Author Ann Hagedorn will be the featured guest, with music provided by Allen Schwartz.
REVIEW OF THE MINUTES.
Review of the minutes from September 6, 2005 regular meeting. Rickenbach MOVED and Alexander SECONDED a MOTION to APPROVE the minutes as amended. The MOTION PASSED 3-0 with an abstention by Singleton.

PUBLIC HEARINGS/LEGISLATION
2nd Reading and Public Hearing #2005-22 Declaration of Conservation Area-Easement.
Rickenbach MOVED and Alexander SECONDED a MOTION for APPROVAL of the ordinance. Hawkey explained that new exhibits from a license surveyor had been included in the packet. He recommended that the original Exhibits A, B and C should be removed and replaced with the Exhibits D, E, F and G. The Exhibits D, E, F, and G should be renamed Exhibits A, B, C, and D. Rickenbach MOVED and Singleton SECONDED a MOTION accepting Hawkey’s recommendation. The MOTION PASSED UNANIMOUSLY.
This ordinance established the 13.950 acres of the eastern portion of the Glass Farm as an intended conservation easement. The conservation easement and entity that would hold the easement has not been finalized.
Swinger opened the public hearing. Sue Abendroth stated that she was glad to see that this suggestion that she had made a few years ago was coming to fruition. Hearing no further comments, the public hearing was closed. The roll was called. The MOTION PASSED UNANIMOUSLY.
1st Reading and Public Hearing #2005-23 Supplemental Appropriations as Emergency.
Alexander MOVED and Hardman SECONDED a MOTION for APPROVAL. Hawkey reviewed the adjustments made to the 2005 budget, which were stated in this Supplemental Appropriations. The new Variance total is $710,758.85 and if approved, the new total of the Annual Appropriations would be $11, 740,736.85. Council suggested that the Finance Director be a part of the budget discussions and the offset revenue could be more adequately displayed in future appropriations.
Swinger opened the public hearing. Y.S. News Editor Bob Mihalek inquired about the wholesale power cost. Hawkey explained that this supplemental appropriation addressed the gap between the rate and the usage. He did not have the all of those figures with him but would provide them to Mihalek tomorrow. Swinger closed the public hearing. The roll was called. The MOTION PASSED UNANIMOUSLY.
Resolution #2005-43 Awarding Bid Software-SSI. Rickenbach MOVED and Hardman SECONDED a MOTION for APPROVAL. Hawkey explained that this software would update the utility department computers by five generations. The cost of the eGovProfessional Software from Software Solutions, Inc. would be $34,873 with a support contract for an additional $7,288. The eGovWeb package could be purchased for $10,000. This would include an online utility payment program. Staff’s recommendation did not include the eGovWeb at this time.
Council asked for clarification of the annual support costs, the need for future upgrades and those costs, and what would be the total costs/savings if the eGovWeb package were purchased now rather than next year. The MOTION PASSED UNANIMOUSLY.
Resolution #2005-44 Beggar’s Night Expenditure.
Hardman MOVED and Alexander SECONDED a MOTION for APPROVAL. The cost for the supplies would be $2,300 for the Beggar’s Night festivities. Beggar’s Night has been scheduled for Sunday, October 30, 2005 from 6:00 p.m. to 8:00 p.m. Due to donations the cost is lower this year. The MOTION PASSED UNANIMOUSLY.
CITIZENS CONCERNS
In answering an inquiry regarding the new traffic signals, Hawkey explained that no cameras had been installed.
SPECIAL REPORTS
There were no special reports scheduled.
OLD BUSINESS
Village Manager Search Committee Update. Rickenbach reported that as of the October 1 st deadline there were 119 applications. The Search Committee had narrowed down the pool and would make additional cuts before presenting a viable list of candidates to Council. The Committee meetings are scheduled for Wednesdays at 11:30 a.m. in the Art Room of the Bryan Center and are opened to the general public. Al Schlueter is the Chairperson.
NEW BUSINESS
Transportation Commission
(Bike Enhancement/Northern Gateway- Rickenbach Memo) & (Swinger Memo). Rickenbach suggested that representatives from various groups working on relative issues concerning transportation could be pulled into on larger group. Council would determine if the commission would stand on its own and whom would it report to. Swinger would meet with the various committees and talk with them about this suggestion. If supported, Swinger would meet with Hawkey and draft a charge for the commission.
Issue 1.
Hawkey recommended that Council pass a resolution supporting Issue 1. He explained that these funds are primarily used to fund various projects related to public works. Council agreed to place this on their agenda for the October 17 th meeting.
Planning Commission.
Burhan Bayraktaroglu had submitted his resume and letter of interest. Rickenbach reported that he had spoken with Bayraktaroglu by phone and stated that Bayraktaroglu has the credentials and experience that would be valuable to Planning Commission. Hardman MOVED and Alexander SECONDED a MOTION to APPOINT Burhan Bayraktaroglu to the Planning Commission. The MOTION PASSED UNANIMOUSLY. Bayraktaroglu would start his five-year term commencing with the October 10th Planning Commission meeting.
MANAGER’S REPORT
Birgitta Valey wrote a letter concerning a paint spill. Zoning Code Enforcement Officer Ed Amrhein will investigate. Her letter implied that it was a purposeful spill.
Hawkey reported that the new traffic signals were operational except the new signal at State Route 343. The Village’s cost was $26,320 for engineering, which was incurred during 2003 and 2004. The total construction cost of the project was $279,000, which was paid by a grant through MVRPC.
In answering Paul Abendroth’s question regarding preemption of the traffic signal for the Fire Department runs, Hawkey explained that the signals would change to allow for a clear path for the any emergency vehicle.
Hawkey also reported that there would be a preconstruction meeting and A & B Asphalt regarding the Street Reclamation Project. He recommended and Council agreed to add 300’ of East Herman St., 200’ of Spillan near Southview and the 700 block of South High St. to the project list. He would use the Dayton Street Issue 2 project funds since that project would not be done at this time.
Hawkey informed Council that there was no legislation needed to suspend the Village’s Gas Aggregation Program.
Peggy Erskine asked if residents would be automatically switched to Vectren. Hawkey answered yes, if the resident did not choose another gas distribution company.
Hawkey further reported that the work was completed at the Waste Water Treatment Plant from the lightning strike and he was working with the Ohio EPA to insure the plant’s code requirements.
He also reported that the library project has begun and the Thistle Creek Phase 1 Development Project would have their amended plans soon.
The Village has two new employees, Carl Bryan as a meter reader/utility service worker, electric and water. Jason Hamby as a utility service worker, streets, parks and sewers.

Rickenbach MOVED and Alexander SECONDED a MOTION to go into Executive Session for a discussion on Property: (1) Conservation Easement (2) Stutzman Lease and Personnel: Employment-Village Treasurer in accordance with the Ohio
Revised Code #121.22(G)(2) and 121.22 (G)(1). The MOTION PASSED UNANIMOUSLY.
Alexander MOVED and Hardman SECONDED a MOTION to return to the General Session. The MOTION PASSED UNANIMOUSLY.
ADJOURNMENT
Having no further business, Rickenbach MOVED and Hardman SECONDED a MOTION to ADJOURN. The MOTION PASSED UNANIMOUSLY.
